DETROIT, MICHIGAN — May 9, 2026 — Gage Green Group (“GGG”), the original cannabis genetics breeding house and seed-stock community founded in 2008, today announced that the United States Patent and Trademark Office’s Trademark Trial and Appeal Board (“TTAB”) has entered final judgment with prejudice in Opposition No. 91278331 in favor of Gage Green Group, ending the Opposer’s challenge to GGG’s pending applications for the GAGE, GAGE GREEN, and GAGE GREEN GROUP marks.
The TTAB’s May 6, 2026 order entered judgment against the Opposer — Gage Growth Corp., a wholly-owned subsidiary of TerrAscend Corp. (OTC: TSNDF) — for failure to prosecute under TTAB Trademark Rule 2.128(a)(3), after the Board issued a March 3, 2026 show-cause order to which the Opposer never responded. The judgment leaves Gage Green Group’s trademark applications, including U.S. Serial Nos. 90324487, 90746550, and 97251818, on track to proceed toward federal registration in the ordinary USPTO examination process.

Background
Gage Green Group is the original Michigan-rooted cannabis genetics breeding house, with continuous commercial use of the GAGE / GAGE GREEN / GAGE GREEN GROUP trademarks dating to 2008. Over the years, GGG has produced more than 400 documented cultivars, championed open-source cannabis genetics, and built an international community of breeders and growers committed to preserving cultivar provenance.
In 2018–2019, a Canadian-incorporated entity that had acquired a separate “Gage Cannabis” trademark application from a Michigan transferor began using brand names overlapping with Gage Green Group’s longstanding cannabis-genetics activity. The May 6, 2026 judgment in Opposition No. 91278331 ends that entity’s federal-trademark challenge to Gage Green Group’s pending applications.
What this means
The judgment removes the principal federal-trademark obstacle to Gage Green Group’s full restoration of its brand presence in U.S. commerce. Subject to USPTO’s standard examination process, Gage Green Group expects its pending applications to proceed toward registration in due course.
Gage Green Group continues its long-standing community work, including educational genetics-preservation programs, support of independent breeders, and stewardship of the cultivar archive that has been the heart of the GGG identity since the earliest days.
